Here is how it works. You e-mail (preferred because copies are better) or fax me a copy of the entire DMV discovery and I will give you an analysis, by phone, fax or e-mail, regarding the case. I will give you a recommendation on the case and my fee for the recommended action. My response is usually same or next day. The fee for the analysis is $75. The above fees are in addition to the $75 analysis fee.
After I have done the analysis you give me instructions on what you want me to do. If I am to do the hearing then I send the DMV a letter stating I am now counsel of record and then I conduct the hearing. If you want points and authorities so you can do the hearing, I prepare the letter and mail, fax or e-mail it to you. Many of my attorneys use this service because they know they won’t miss any issues.
Another alternative is for me to do all your hearings. If you want me to do all your DMV hearings you merely send me a letter so stating and we will set up a discounted fee arrangements. You provide the initial client information such as arrest date, agency, client name, address, phone numbers, DOB and DL #. I will then request the DMV hearing. You get copies of everything either by e-mail or fax. In most cases where I do all the hearings for an attorney I charge a flat rate of $500 per hearing. That service includes all services for the case including subpoenaing documents, preparing witness declarations and expert witness declarations and testimony. I am also willing to work out a lower fee agreement if you agree to send me at least 5 cases per month.
If the suspension is upheld, I send the client a letter explaining the writ process. If you prefer, I tell the client my fees which are between $3,500 and $5,000 plus costs of about $600 to $1,000, depending on the length of the transcript. The writ fee depends on location of the court and the complexity of issues. If the client wants to proceed I handle everything including client contact. Or, I will tell the client to call you to decide how to proceed. If the client wants to do a writ, I draft the writ pleadings in your name and you do the hearings. The first hearing is on the ex parte request for stay and the second is the hearing on the merits. My fee for this service is $2,500. You charge your client what you want and you pay the fees and maintain client contact.
I also provide my attorney clients with free telephone consultations on questions you may have regarding issues other than consultation on a specific case. If you have a question you can call, fax, or e-mail your question at your convenience.
The attorneys I work for report that clients are very pleased to receive a copy of the points and authorities letter and are impressed with the effort made to save their driver’s license.
Many of my attorneys want the points and authorities letter done even if the case is not likely to succeed. The client gets the letter showing what work has been done and the attorney avoids the time necessary to prepare and conduct the hearing. The attorneys also like the assurance that the case has been properly presented so that if the client wants to take a writ if the suspension is sustained.
It is my preference to work for attorneys. The attorney retains the client contact and I deal with you with the exception of those cases that require the client’s testimony. On occasion I have a client ask me about the criminal case. I politely decline to discuss the criminal case with a client of yours. I am very careful to not allow my work for you to in any way interfere with your representation in the criminal case. I am sure you will find that my reputation with attorneys is that I never interfere in the criminal case. Of course, there have been some occasions when the attorney has asked me to take over the criminal case.
GRAPHS :
I provide graphs showing the progress of the driver’s BAC from the time of the stop to the time of the tests. I will need a copy of the arrest report, a driver’s questionnaire, the test records or lab report and any accuracy records. Fees range from $350 to $750 depending on the complexity.
I can also provide an affidavit or declaration for your expert to be used in the DMV hearing. My fee for the expert’s declaration is $250 to $500. Fees for graphs range from $250 to $500 depending on the complexity of the case.
MOTIONS :
I also provide drafting of motions in criminal cases. Fees usually range from $250 to $500 depending on the complexity.
