Alcohol is absorbed into the body over time.  It usually takes about an hour for a drink to be fully absorbed.  This means that if you stop drinking and are stopped shortly after completion of the last drink your BAC, Blood Alcohol Concentration, will continue to rise until you are tested.  In many cases it is best to establish that the time of completion of the last drink is as close as possible to the time of the stop.  Most people believe that it is best to tell the officer there was a considerable time lapse from the time of last drink to the stop.  This is wrong.

It is very difficult to establish exact times for our purposes.  It is best to start at the time of the stop and reason backward in time.  Keep this in mind as you complete this questionnaire.

The single most important issue in most DUI cases in the driver's Blood Alcohol Concentration, BAC, at the time of the stop. The result of the Blood, Breath or Urine test is merely circumstantial evidence of the driver's true BAC at the time of the stop. Advocate Legal Service can determine your BAC at the time of the stop for you.

To obtain your BAC at the time of the stop, printout the questionnaire on the Form page. Complete the information and fax the form to Advocate Legal Service. We will input this information into a computer program based on the accepted scientific formula to obtain a BAC at the time of the stop. When completed, the printout will be faxed to you with a brief explanation and a recommendation based on the BAC and drinking pattern. The normal fee is $50 paid by credit card.
